Every moment I spend trying to craft and deliver an assignment that can't be cheated on is a moment I'm not spending explaining a substantive concept. To do that on the strength of the assumption that some students will be inclined to cheat is to punish everyone for my own assumptions about a few.

I'm also reluctant to stand at the front of the class, before a group of people I'm only just meeting for the first time, and casually inform them that I don't trust them. That doesn't engender the kind of dynamic I'm aiming for and as a student I would have been put off by that tack immediately.

26 August 2026 @ 2:14 am

And while it may be the least important factor, and it is definitely peculiar to law and other professional disciplines, I don't think it makes a ton of sense to do anything that makes the classroom experience significantly different from practice. </rant>

I'll caveat all of that with a general observation that none of the above is to suggest I believe those resorting to blue books and pencils, etc. are *wrong* -- just that there is definitely another side to consider.

Seeing a lot of discourse around AI and assignment creation. I definitely do what I can to make it straightforward to *not* cheat and more difficult *to* cheat, but I’m not giving up on writing assignments entirely. I have more faith in my students than that. Small diatribe incoming.

26 August 2026 @ 2:14 am

I don't think the art, science, or magic of writing is going away because AI can do a serviceable job of it. Owing to that, I reckon that it's my job to do the best I can to deliver graduates that can reduce their ideas to the written form with as much fidelity as possible.

States looking for a route forward after Maryland’s digital ad tax foundered, take heart. It’s doable just boring.

Whenever my vanity Google search alert fires off that I’m mentioned by another city council or state house in an anti-data center bill, my heart warms.

Interesting little finding: The eCFR is the public's authoritative lens into what fed regs say—including what they said on past dates. We found a case where that view lagged: for weeks after an amendment's effective date, eCFR rendering continued to show pre-amendment text.

If you haven’t given Wallflower a shot as a Bluesky/Mastodon reader (also RSS feeds, “Commonplace Book,” read it later, etc.) — consider doing so. Lots of quality of life improvements. I’ve been blowing through a backlog of articles with the custom podcast feed.
