Reads to me like 4-4 on the constitutional question of birthright citizenship, with Kavanaugh out in "this is just a statutory question" land.
That seems ... precarious.

Re: Barbara birthright citizenship decision, Kavanaugh thinks of it as a statutory question under 8 USC 1401(a). Hard not to see the throughline between "let Congress do it if it wants to" and the FEC election funding floodgate decision.
